When Should You Contact a Lawyer?

In the course of one’s lifetime, there will probably be some occasions when it will be necessary or at least advisable to see a lawyer. Here are some general rules that should be helpful in guiding you in making this decision.

In civil actions – such as damage suits, suits for breach of contract, etc. it is essential to have a lawyer if you are sued for a substantial amount. You need a lawyer if you need to sue someone for more than $7,500, which is the maximum limit that can be recovered in small claims court in Minnesota. If a criminal charge is made against you or a family
member, you must have a lawyer. The seriousness of possible penalties requires that a criminal defense attorney should be consulted at once if you run afoul of the law.

In addition, there are many types of matters that can arise that should lead you to consult a lawyer, as compared to must. For most people, a lawyer is regarded as a luxury we can postpone until a crisis comes up. This attitude is unfortunate, since an attorney’s advice can often help you avoid serious problems before they develop. If you can do so, everyone should at least have a lawyer whom you can call when advice is needed or when
emergencies arise. Like having a minister and doctor to consult, having a family lawyer whom you can contact for advice is a resource that can be of help in times of need.

You should consult a lawyer when you wish to make a Will or Trust, or are revising one; when you have been involved in an automobile accident and are being sued for more than the limits of your insurance coverage; when you have been injured in an auto accident; when a written contract is presented for your signature; when a contract dispute arises; when you wish to adopt a child; when you wish to form a business entity; when you have a patent, trademark or copyright you wish to establish; if you are involved in a divorce; if a family member has died and a probate proceeding is needed; if problems arise regarding ownership, sale or purchase of real estate. These are examples of the many instances
where a lawyer can provide the necessary counsel and representation to provide the help you may need.
